What do the manufacturers recommend a sales representative carry for insurance?
It is not possible for a manufacturer to know all aspects of a Sales Rep’s personal or business insurance needs. As an independent business professional, it is critical that all reps seek advice from a qualified insurance broker to help identify and manage the nuances of commercial insurance.
Reps should ensure they have personal or business coverage at minimum that includes medical insurance and lost income/disability insurance to cover you in the event of an injury. Reps should seek guidance on their individual state employer requirements on their employees or temporary labor with regards to worker’s compensation, unemployment, or other state required coverage.
It is recommended that reps carry sufficient auto or home/business insurance coverage to protect the value of their sample/demo product or other sales materials in the event they sustain a loss.
Your insurance carrier can make recommendations regarding risk areas associated with your individual business needs.
Reps should be sure to check any personal policies to ensure their business operations are covered under that policy. An auto accident is often excluded on a personal policy when using the vehicle for business purposes, as an example. Another area to ensure coverage, is if you have any employees or per diem help driving your vehicle, be sure they are considered a covered driver on your policy for business use.
If you are holding personal vs. commercial policies, be sure to discuss your business needs with the company or insurance broker.
In the event a person is injured on any products sold by the company, the company typically maintains coverage to investigate and defend any injury claim alleged to be caused by a failure of, or defect in, the product. In the event a rep is sued for any alleged product defect or failure issue, the company would typically assume all defense of the claim.
If you are participating in a company-hosted event, the company would defend general liability claims associated with that event. Beyond that, though there may be some nuanced situations, a rep should have their own general liability policy to cover you against any non-product related claims. For example: your tent blows over and hurts someone.
Personal Owned Autos: Independent reps using personally owned autos, need to maintain their own collision and liability auto coverage; there is no coverage available under the Company’s insurance program.
Company Owned Autos: Anyone approved to be driving a company owned or leased vehicle, is covered for collision and liability auto coverage under the Company’s insurance program. A valid driver’s license and clean driving record is required.
Product & Personal Belongings: Company owned product is typically protected by insurance coverage against theft or other loss, regardless of whether it is in the Company’s facilities at the time (e.g. at trade shows, at a demo event, or in a rep vehicle.)
Rep owned product is not covered under the Company’s property loss insurance coverage. It is recommended that reps carry sufficient auto or home/business insurance coverage to protect the value of their sample/demo product or other sales materials in the event they sustain a loss.
